Partner Route visa secured despite being an overstayer

The background
Our client - an Indian National - came to us after marrying her husband (a British National). Before coming to us, her previous solicitor told her that as long as she got married to her partner she could make the application for a spouse visa after her student visa expired. Unfortunately, this advice was incorrect and she had subsequently become an overstayer.
What we did
As our client came to us as an overstayer, working as quickly as possible was essential. To do this, we worked closely with our client and her husband to make this application. We submitted our application, and also submissions to explain why the application was being made out of time. We submitted the application on an expedited basis in order to renew our client’s legal status as quickly as possible.
The outcome
Our application was successful. The Home Office granted permission for our client to stay in the UK under the Partner (FLR M) route of the Immigration Rules. This has meant our client’s stay has been regularised, so her and her husband are able to continue their lives together in the UK. We wish them all the best for their future together.
